Code of Conduct for Workplace

Sexual harassment of women is a serious offence against human dignity.  It results in violation of the fundamental rights of women to equality. Equality in employment can be seriously impaired when women are subjected to gender specific violence such as sexual harassment in the work place. This institution is committed to provide a safe and conducive environment for women at the workplace.

 

In an effort to promote the well-being of all women employees at the workplace, and to protect the right to live and work with dignity, the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013( “the Act”) was enacted.

 

Under this Act, the meaning of sexual harassment includes any one or more of the following unwelcome acts or behaviour (directly or by implication):

 

  • Physical contact and advances
  • A demand or request for sexual favours
  • Making sexually coloured remarks
  • Showing pornography
  • Any other unwelcome physical, verbal or non-verbal conduct of sexual nature

 

Any act or conduct by a person in authority which denies or would deny the equal opportunity in pursuit of career development or otherwise make the environment at the workplace hostile on the ground of the person’s sex, would amount to an act of sexual harassment.

 

Redressall Mechanism

 

The mechanism for redressal of complaints and further procedure to be followed for conducting an enquiry by the Internal Complaints Committee is set out in the Act itself.

Any aggrieved woman may make, in writing, a complaint of sexual harassment at workplace to the Internal Committee if so constituted, or the Local Committee, in case it is not so constituted.  (Provided that where such complaint cannot be made in writing, the Presiding Officer or any Member of the Internal Committee or the Chairperson or any Member of the Local Committee, as the case may be, shall render all reasonable assistance to the woman for making the complaint in writing).

Where the aggrieved woman is unable to make a complaint on account of her physical or mental incapacity or death or otherwise, her legal heir or such other person as may be prescribed may make a complaint under this section.

The Internal Committee or, as the case may be, may before initiating an inquiry and at the request of the aggrieved woman, take steps to settle the matter between her and the respondent through conciliation. It is specifically provided in the Act that no monetary settlement shall be made the basis of conciliation.

If a settlement is arrived at, the Internal Committee, as the case may be, shall record the settlement so arrived and forward the same to the employer and a copy to the Local Committee regarding the action taken. Copies of the settlement as recorded shall also be provided to the complainant.

Punishment for false or malicious complaint and false evidence

 

Where the Internal Committee of the campus arrives at a conclusion that the allegation against the respondent is malicious or the aggrieved woman or any other person making the complaint has made the complaint knowing it to be false, or the aggrieved woman or any other person making the complaint has produced any forged or misleading document, it may recommend to the competent authority to take action against the woman or the person who has made the complaint in accordance with the provisions of the service rules applicable to her or him or where no such service rules exist, in such manner as may be prescribed.

 

Disciplinary Action

 

Where, after the enquiry, it is concluded that the allegation against the respondent amounts to sexual harassment, such act shall be treated as misconduct in accordance with the applicable service rules or where no such services rules have been made, in such manner as may be prescribed.

The respondent may also be directed to pay the aggrieved woman such sum as may be determined by the Internal Committee or the Local Committee.  Such sum may also be deducted from the salary or wages of the respondent and paid to the complainant.

Third Party Harassment

 

Where sexual harassment occurs as a result of an act or omission by any third party or outsider, the employer and the persons in charge shall take all steps necessary and reasonable to assist the affected person in terms of support and preventive action.

Submission of Reports by Internal Complaint Committee

 

 

  1. The Internal Committee shall in each calendar year prepare in prescribed form and prescribed time as may be prescribed, an annual report and submit the same to the employer and the District Officer.

 

  1. The Institution shall include in its report the number of cases filed, if any, and their disposal under this Act in the annual report of the Institute or where no such report is required to be prepared, intimate such number of cases, if any, to the District Officer.

 

  1. The Act mandates submission of any Annual Report by the ICC/LCC to the employer/District Officer. The District Officer will forward a brief report on the annual reports to the appropriate State Government.  Such reports must include the following information.

 

  • of complaints received
  • of complaints disposed of
  • of cases pending for more than 90 days
  • of workshops/awareness programmes carried out
  • Nature of action taken by the employer/DO

The Report of the  ICC will be forwarded to the District Officer through the employer

Crest of SXC

The Crest of St. Xavier’s College is modeled on Jassu Crest of the College Patron Saint Francis Xavier’s family. It has been adapted to local surroundings, suggestive of a native flavour of a College in India. The escutcheon in white and blue contains a tiger and a palm tree, overlooked by a silver crescent moon, which symbolizes the palacio of Xavier. The charge on the Dexter, HIS, bespeaks a College of the Society of Jesus (Iesus Hominum Salvator – Jesus, Savior of Human Family). The checky argent and sable in the base recall the spirit of the Xaverian family. A garter bearing the words “St. Xavier’s College, Calcutta”, encircles the escutcheon and it is surmounted by a Cross emanating holy rays. A scroll passes underneath inscribed with the words Nihil Ultra (Nothing Beyond), the motto of the College. The Crest signifies dignity, courage, quiet gleam and the call of the beyond – the quest persists towards higher endeavour.

A Christian Minority Higher Educational Institution, St. Xavier’s was founded in 1860 by a Catholic Minority Religious body, the Society of Jesus, and was affiliated to Calcutta University in 1862. While preference is shown to the educational and cultural needs of the Minority community, admission is open to all irrespective of caste, creed and nationality!
